Understanding the Legal Status of THCA

What is THCA?

Tetrahydrocannabinolic acid (‘THCA’) is a non-psychoactive compound found in raw cannabis plants.

This compound is the precursor to THC, the psychoactive component in cannabis responsible for the “high.” THCA is converted to THC through decarboxylation, a process triggered by heat or prolonged storage.

In its natural state, THCA is non-psychoactive and does not interact significantly with cannabinoid receptors CB1 or CB2, meaning it does not produce intoxicating effects. 

However, when exposed to high temperatures — during smoking or vaping for example — it may convert into Δ9-THC, a controlled substance under the Misuse of Drugs Act 1971 (‘MDA’).

Legal Framework Governing THCA in the UK

THCA itself is not listed as a controlled drug under the MDA. It is generally accepted as non-psychoactive when consumed. 

According to a 2023 report by the Advisory Council on the Misuse of Drugs (‘ACMD’):

  • THCA shows weak activity at cannabinoid receptors and is unlikely to convert to significant amounts of Δ9-THC within the body after ingestion.
  • Decarboxylation, and the subsequent creation of controlled substances occurs primarily through prolonged exposure to very high temperatures (100+ degrees Celsius). At lower temperatures, this conversion is negligible.

The ACMD’s position is informative and thus, it can be concluded that THCA in its natural form is non-psychoactive and not controlled under UK law. It should of course be noted that the ACMD report has not been formally adopted by the Home Office, and therefore cannot be considered fixed law, but its assertions in relation to the properties of THCA are helpful.
